ATTENTION MEDICAID BENEFICIARIES: NOTICE OF YOUR RIGHTS UNDER HAWKINS v. COHEN

Hawkins v. Cohen (5:17-CV-581 E.D.N.C.) is a federal lawsuit filed in 2017 on behalf of Medicaid beneficiaries in North Carolina. The case concerns improper terminations of Medicaid benefits.

The Court hearing the case has certified it as a class action. This means that the case is to help not just the people who filed the case but other Medicaid beneficiaries whose Medicaid has been or will be terminated improperly.

The Court has ordered the N.C. Medicaid agency to stop terminations or reductions of Medicaid benefits until eligibility under all Medicaid categories has been considered and advance notice of the right to a hearing has been mailed to you. For example, if you get Medicaid based on having a minor child who is turning eighteen years old, your county Department of Social Services must consider whether you are disabled before they stop your Medicaid.

Hawkins v. Cohen (5:17-CV-581 E.D.N.C.) es una demanda federal presentada en 2017 en nombre de los beneficiarios de Medicaid en Carolina del Norte. El caso se refiere a terminaciones inadecuadas de beneficios de Medicaid.

Lisa Osborne, Director of Alleghany Department of Social Services. Lisa has worked with Alleghany DSS since 1997. She graduated from New River Community College with an Associate's Degree in Business Administration and went on to get her Bachelor's Degree in Social Work from Appalachian State University. Lisa started with the department doing Adult Services and was the Adult Home Specialist for the county. In 2005 Lisa moved in to Children Services and worked in that position until she became the Social Worker Supervisor in 2010. She was responsible for supervising Adult Services, Children Services, and Child Care Subsidy. In 2015 Lisa became the Director of the Department of Social Services.

The Department of Social Services offers and array of services to the public. Our Income Maintenance Unit is responsible for the implementation of Food and Nutrition Services, Crisis Assistance for heating and cooling, LIEAP assistance for heating, Special Assistance for Adults, Program Integrity, Carolina Access, TANF- Work First Assistance, Health Choice for Children, Carolina Access, Medicaid Transportation Assistance, and Medicaid Assistance. These are all income based programs. Applications are available at the Department of Social Services and can be done through EPASS which is an online portal. For more information regarding these programs you may contact the Supervisor, Detha Shepherd or anyone within the income maintenance unit.

Child Support Enforcement Services is responsible for establishing paternity, child support orders, enforcement of child support orders, locating absent parents, and interstate services regarding child support. For more information regarding Child Support you may contact the supervisor, Angie Sexton or Ellen Bennett.

Adult and Family Services is responsible for providing Child Care Subsidy, Adult Protective Services, Adoption Assistance, In-Home Aide Services, Information and Referral, Guardianship, Payee Services, Services for the Blind, Medicaid Transportation, and Support Services for those in need. For more information regarding Child Care subsidy you may contact Shane Atwood or Margaret Williams. For adult services, including; Adult Protective Services, Adoption Assistance, In-Home Aide Services, Information and Referral, Guardianship, Payee Services, Services for the Blind, Medicaid transportation services, and Support Services you may contact the Supervisor, Shane Atwood or Autumn Hodges.

Child and Family Services provide child protective services, foster care for children, information and referral assistance, LINKS services for youth, and foster parent licensing. For more information regarding these services you may contact the supervisor, Leia Crouse or someone in the children services unit.
